Vietnamese Naturalization: Conditions, Application Dossier, Procedure, and Crucial Considerations

Vietnam holds a profound place in the hearts of every overseas Vietnamese. With the expanded policies in the 2025 Law on Nationality, returning overseas Vietnamese and foreign experts seeking a long-term life in Vietnam now have greater opportunities to become official citizens of the country. This article will guide you step-by-step, from the legal conditions to the specific application dossier and the submission procedure for acquiring Vietnamese citizenship, in a clear, comprehensible manner that strictly complies with current regulations.

Vietnamese Naturalization: Conditions, Application Dossier, Procedure, and Crucial Considerations

I. Who can apply for Vietnamese citizenship?

1. Repatriating Overseas Vietnamese

These are individuals who previously held Vietnamese citizenship, then settled abroad and acquired another nationality. In many cases, they still retain their Vietnamese roots through personal documents, civil status records, birth certificates, or documents related to their parents or grandparents.

Overseas Vietnamese can apply to restore their Vietnamese citizenship, or in some cases, be considered for dual citizenship if they meet the legal conditions.

2. Experts and long-term foreign residents

Vietnam is currently promoting policies to attract experts, intellectuals, scientists, and investors to work and settle down. These individuals, after a period of stable residence and positive contributions to the socio-economy, may also be considered to acquire Vietnamese citizenship.

II. Necessary conditions for citizenship application

1. For Overseas Vietnamese

  • Have documents proving they were once Vietnamese citizens or have Vietnamese origins.
  • Have a legal residence in Vietnam (owning a home or having sponsored residency).
  • Have a clear background, with no violations of the law domestically or internationally.
  • Have a genuine desire to repatriate and commit long-term to Vietnam.

2. For experts

  • Have been legally residing in Vietnam for 5 years or more.
  • Have documents proving professional competence (degrees, labor contracts, job offer letters, etc.).
  • Have made practical contributions in professional, economic, scientific, or technological fields.
  • Have a basic understanding of the Vietnamese language (some cases may be exempted under special policies).

III. What documents need to be prepared?

The citizenship application dossier must be prepared carefully, clearly, and accurately, typically including:

  • Application for Vietnamese citizenship (according to the prescribed form).
  • Currently used foreign passport.
  • Documents proving Vietnamese origins (for Overseas Vietnamese): birth certificate, old household registration book, old Vietnamese passport, etc.
  • Documents proving legal residence in Vietnam: temporary residence book, land use right certificate (red book), lease agreement, etc.
  • Criminal record certificates (both domestic and foreign).
  • Degrees, professional records, employment confirmation letters (for experts).
  • Translated, notarized, and consular legalized documents if they are foreign documents.

Note: Documents must be translated into Vietnamese and notarized by a competent authority in Vietnam. Foreign documents must be consular legalized before use.

IV. Submission and approval process

Step 1: Document preparation

Drafting, translating, notarizing, and thoroughly reviewing all required documents according to regulations.

Step 2: Dossier submission

  • Submit at the Department of Justice of the province/city where you reside in Vietnam.
  • Submit at the Embassy or Consulate if you are abroad.

Step 3: Dossier processing

The dossier will be appraised by inter-agency bodies such as the Ministry of Justice and the Ministry of Public Security. Some cases may require additional documents or explanations.

Step 4: Decision by the President

Once the conditions are met, the President of the State will issue a decision granting citizenship. This is the legal basis for issuing valid Vietnamese citizen documents.

Processing time: From 6 to 12 months, depending on the specific case.

V. Important considerations

  • Some special cases may be allowed to hold dual citizenship if permitted by the President of the State.
  • Original documents should be prepared in advance, especially for Overseas Vietnamese who have lived away for a long time.
  • It is advisable to have a lawyer or a specialized agency assist to ensure the correct process and save time.
