[LEGAL PERSPECTIVE] Managing Collection and Disbursement Funds in Apartment Operations
This article provides a detailed legal analysis of the misappropriation of collected funds by a Residential Management Unit under Vietnamese law. However, an unexpected situation arose when the Water Supply Company announced a suspension of service because the Management Unit failed to pay the water bills for 7 consecutive months, despite having already collected the money from the residents. This has sparked significant controversy within the community regarding the legality and ethics of this behavior.

The Management Unit responded that all information remains unofficial until an announcement is made by the Management Board, implying that the notice from the Water Supply Company is also unofficial.

REASONS FOR NON-PAYMENT OF WATER BILLS
According to information from the community, a resident using the Zalo handle “Do Thi QuynhHuong” suggested that the Management Unit used the collected funds to pay for personnel and other administrative costs. This appears to stem from an urgent need to maintain the unit's operations; however, such actions may violate the regulations stipulated in the contract between the Management Unit and the residential community.

ANALYSIS OF THE APARTMENT MANAGEMENT SERVICE CONTRACT
Contracts between a Management Unit and the residential community typically clearly define responsibilities for collection, disbursement, and the management of these funds. According to general regulations, the collected funds must be used for the correct purpose as agreed upon—specifically, to pay for predetermined utility services (such as water). Using this money for other purposes, even to maintain the operations of the Management Unit, without the consent of the residents (the owners of the funds), is considered a breach of contract.

ANALYSIS OF THE VIOLATION
Under Vietnamese law, particularly within the Civil Code and the Penal Code, the misappropriation of collected funds for the wrong purpose can be deemed a breach of contract and may lead to legal sanctions. Specifically:
Regarding Civil Liability
The failure of the Management Unit to pay water bills for 7 months, despite having collected the money from residents, can be considered a violation of contractual obligations. However, there is a detail that the Management Unit "forgot": the management contract between the Management Board and the Management Unit is no longer legally valid. Therefore, the management situation at Mieu Noi 18-Story Apartment differs from other buildings; this tactic of misappropriating funds might very well be the Management Unit's last move.

CONCLUSION
From the analysis above, it is evident that the actions of the Management Unit in using collected funds to pay for other expenses without resident consent constitute a breach of contract and may trigger legal sanctions. To protect their interests, the community needs to closely monitor financial income and expenditure, ensure the transparency of the Management Unit’s accounting records, and, if necessary, seek support from legal authorities to resolve the issue fairly.
